Ah, but he's NOT! He's an "administrative law judge," which is a class of arbitrators which were called "referees" until a few years back when they got the title inflation. ALJs aren't judges in any real sense; they can make decisions in arbitration, but those are because the two sides have agreed to abide by the decision.
I seem to remember that Anita Hill's "judge" friend, (Susan Hoerschner was it?) was actually an ALJ, too, though all the senators called her "Judge."
