Premise 5 and the conclusion presume that Batman has perfect information. Unless we want to add "Premise 6 -- Batman is omniscient," then the logic fails.
I was once at a party where I overheard the following conversation: "Who would win in a fight: Batman vs. Superman and Batman doesn't have any kryptonite." "Uh, Superman." "Wrong. Batman uses his kryptonite to defeat Superman." "But you just said Batman didn't have any kryp–" "Batman always has kryptonite!"
